 ANTI-CORRUPTION AND BRIBERY POLICY ANTI-CORRUPTION AND BRIBERY POLICY

 
Constamarie Logistics Sdn Bhd and Constamarie Forwarding & Shipping Sdn Bhd (“Constamarie”) are committed in conducting its business in an honest and ethical manner.
 

Definition of Corruption & Bribery

Corruption is the misuse of entrusted power for private gain. Bribery refer to the offering, promising, giving, accepting or soliciting of an advantage as an inducement for an action which is illegal, unethical or a breach of trust. Inducements can take the form of money, gifts, rewards or other advantages.
 

Responsibility

This Policy is applicable to Directors and Employees of Constamarie. This Policy need to be read and understand clearly. Disciplinary action will be taken if violation of the Policy, including termination of employment. All third parties performing work on behalf of Constamarie, including agents, sub-contractors and suppliers are required to understand and comply with the Policy.
Corruption and bribery are detrimental to business so that Constamarie adopts a zero tolerance approach to all forms of corruption.
 

Guidance on Common Forms of Corruption & Bribery

1. Gift, Entertainment and Hospitality
Directors and Employees or third parties acting on behalf of Constamarie are prohibited from directly or indirectly, receiving, providing or soliciting for gifts. Gifts and entertainments may only be presented to a third party only in the situation which cannot be interpreted as inducements to trade and it is in accordance with customary business practice. Guidance from the management must be sought if there is any doubt regarding this issue.

2. Donation and Sponsorship
Any donations, sponsorships and charitable contributions by Constamarie must be done with the approval of the Directors and it must be done in a transparent manner for social and moral responsibility.

3. Facilitation Payments
Facilitating payments are payment that may constitute a bribe and is made with the intention of expediting an administrative process. Directors or Employees or third parties acting on behalf of Constamarie are prohibited from offering, soliciting or receiving bribes of any forms including facilitation payments. Employees or third parties acting on behalf of Constamarie must immediately notify immediate superior or management for consultation.
 

Record Keeping

All financial record should be in proper filling to be maintained with accuracy and completeness for all payments made to third parties in the ordinary course of business which is prove as evidence that such payments not linked to corrupt and/or unethical manner.
 

Reporting of Violations of the Policy

Any concerns, questions or reports should be addressed to firstly to their immediate superior or Head of Department. Any reports made for violation of the Policy will be treated very seriously, accordingly and confidentially.
 

Review of the Policy

The top level management will monitor compliance with the Policy and review the Policy regularly to ensure that it continues to remain relevant and appropriate.
 

  DRUGS AND ALCOHOL POLICY  DRUGS AND ALCOHOL POLICY

 
Constamarie Logistics Sdn Bhd and Constamarie Forwarding & Shipping Sdn Bhd (“Constamarie”) are strictly prohibit all staff and/ or all third parties performing work on behalf of Constamarie, including agents, sub-contractors, and suppliers, whilst within our premises or client worksites, be in possession of, or be under the influence of drugs and alcohol.

The Company recognizes the medical drug which have been prescribed by a professional medical practitioner, especially for own treatment. In this case, evidence in the form of a doctor’s prescription for such medicine or drug must be produced on demand.
Violation to this policy may result in termination of employment and in some cases may be referred to the law enforcement officers.
